Terms of Service

Last updated: 2026-10-09

These Terms of Service govern use of vkWorkforce, a software platform operated by VisionKraft Consulting (“we”, “us”) and used by healthcare staffing agencies and home-care agencies (each, an “Agency”) to coordinate employment communications with their own clinical employees, clients, and partners.

By using vkWorkforce or by receiving messages sent through it on an Agency’s behalf, you agree to these terms. See also our Privacy Policy.

Roles and health information

Each Agency controls the information it puts into vkWorkforce and is responsible for its own legal obligations to its workers, applicants and clients. VisionKraft Consulting processes that information on the Agency’s behalf. An Agency that stores protected health information (PHI) in the platform must have a business associate agreement in place with VisionKraft Consulting before doing so, and remains responsible for HIPAA notices, client authorizations and records-retention schedules.

Worker portal and timekeeping

Some features are available through secure worker links that allow a worker to view assignments, clock in, clock out, and complete timesheet steps without a separate login. You are responsible for keeping those links private and for notifying your Agency if you believe a link or device has been compromised. Agencies remain responsible for reviewing time records, overrides, and payroll approvals before payment.

Clocking in records your location at that moment. For home-care visits the app also records a location trail from clock-in to clock-out (including in the background) to verify the visit; it stops when you clock out.

Monitoring and recorded interactions

When enabled by an Agency and permitted by law, the platform may support attendance monitoring, geofence checks, webcam snapshots, activity signals, call recording, transcription, and related AI-assisted review or scoring. Agencies are responsible for providing any workplace notices, disclosures, consents, or accommodation processes required for those workflows.

Workplace monitoring does not start until the worker has been shown the disclosure and has consented. Call recording is off unless the Agency turns it on; when it is on, each recorded call opens with a recording announcement before recording begins. Washington requires the consent of everyone on a call to record it, so a caller who does not agree should end the call. Recordings are deleted after 90 days.

Agencies that use automated or AI voice calling are responsible for having any consent the law requires from the people they call (including under the Telephone Consumer Protection Act) and for honouring do-not-call requests.

The mobile app offers optional voice dictation for typing notes by voice. Speech is converted to text by the device operating system’s built-in speech recognition, which depending on the device and its settings may transmit the audio to Apple or Google for processing. Workers are shown a notice before first use and can always type instead; Agencies should direct workers not to dictate information they would not put in writing.

Applicant submissions and screening

If you submit an application through the platform, you represent that the information you provide is accurate and that you have the right to upload any resume, certification, or other materials you submit. Agencies may use the platform to coordinate interviews, verify credentials, or initiate third-party screening that is governed by the Agency’s own hiring documents and legal obligations.

Background checks are ordered under the Fair Credit Reporting Act. The platform will not order a report until the worker has signed a written authorization after seeing a standalone disclosure, and it supports the pre-adverse notice, waiting period and adverse action notice the Act requires. The Agency, as the user of the report, remains responsible for its certifications to the reporting company, for any state or local fair-chance rules, and for its employment decisions. See A Summary of Your Rights Under the FCRA.
